Terms & Conditions

Scope
These Terms and Conditions apply to all membership agreements between Kingdom HQ and its members.

Minimum Age
Membership is open to any natural person who has reached the age of 18. For persons under the age of 18, the membership agreement must be concluded by their legal guardians. Membership is non-transferable.

Contract Duration
Membership agreements have an initial term of 1, 3, 6, 12, or 24 months. After the initial term expires, the contract automatically continues for an indefinite period, unless it is cancelled by either party at least one month before the end of the initial term in text form (e.g., email).

After the contract has been extended for an indefinite period, it may be cancelled at any time with one month’s notice to the end of the month.

Membership Fees
Members are responsible for ensuring that their bank account has sufficient funds at the time of debit. If a debit cannot be processed, any resulting costs shall be borne by the member.

If a member is in arrears with more than four monthly payments, all remaining membership fees until the end of the contractual term become immediately due.

The statutory value-added tax (VAT) is included in the monthly membership fee. In the event of an increase in the statutory VAT rate, the membership fee will be adjusted accordingly.

Membership fees are payable regardless of the extent to which the services are used. The same applies in the event of extraordinary termination of a membership contract by Kingdom HQ for good cause.

Kingdom HQ reserves the right to charge reminder and default fees. This also includes costs incurred for appropriate legal enforcement.

Kingdom HQ is entitled to assign claims arising from this membership agreement to the external service provider:

Finion Capital GmbH
Raboisen 6
20095 Hamburg
Germany

and to transfer the collection of claims to this provider.

The member agrees to the transfer of their personal data (name, address, date of birth, start date, contract duration, payment cycle, termination status, amount owed, IBAN, BIC, and account holder of the bank account used for direct debit) for the purpose of collecting payments arising from the membership agreement.

The member grants a valid SEPA direct debit mandate, authorizing Eurofit24 to collect payments from their account and instructing their bank to honor these direct debits.

Change of Residence
If a member moves to a new residence located more than 30 km from the studio, the membership may be terminated early with one month’s notice to the end of the month.

The cancellation must be submitted in text form and must include proof of registration at the new place of residence.

Suspension of Membership Due to Pregnancy
Upon request, membership may be suspended free of charge for a predetermined period of full calendar months.

The request must be submitted in writing and must include appropriate proof. Only a medical certificate will be accepted as proof.

The original contract term will be extended by the duration of the suspension.

In the case of pregnancy, the suspension period is limited to a maximum of 12 months.

The right to extraordinary termination remains unaffected.

Health Responsibility
Each member is responsible for their own health condition and physical capability. Use of the facilities and participation in training is at the member’s own risk.

Members are responsible for obtaining a medical assessment of their health condition before beginning training and confirming that they are physically fit to participate in the offered sports.

Data Protection (GDPR)
Kingdom HQ places great importance on the careful handling of personal data in accordance with EU data protection regulations (GDPR).

The following personal data may be stored:

• first and last name
• address
• postal code and city
• email address
• phone number
• date of birth
• bank details
• health-related information

Additional information required to fulfill the membership contract may also be collected.

As a general rule, personal data will not be shared with third parties, except where required to fulfill contractual obligations.

Members have the following rights under GDPR:

• right to withdraw consent
• right to access personal data
• right to correction
• right to deletion
• right to lodge a complaint with a supervisory authority

The member confirms that they have taken note of the full privacy policy.

Use of Images
The member agrees that Kingdom HQ may use their photograph for identification purposes within the check-in system.

Liability
Kingdom HQ, its service providers, employees, and agents are liable for damages, regardless of the legal basis, only if such damages were caused intentionally or through gross negligence, or if a material contractual obligation (cardinal obligation) has been breached.

Cardinal obligations are obligations whose fulfillment is essential for the proper execution of the contract and on whose compliance the member may regularly rely.

This limitation of liability also applies in particular to the loss of personal valuables.

Member Obligations
Members must inform the studio immediately of any changes to their name, address, or bank details.

Any additional costs resulting from failure to provide this information are the responsibility of the member.

Training staff are authorized to issue instructions necessary to maintain proper operation, order, and safety within the martial arts school. These instructions must be followed.

Use of the Studio
Members are entitled to use the facilities of Kingdom HQ as contractually agreed during the official training hours, including changing rooms and showers.

Opening hours and class schedules are determined by the martial arts school and may be subject to change.
